People v. M.W.
The defendant was charged with driving under the influence, speeding, improper lane usage while having an open container of alcohol in his center console. Attorney Joe Venditti was hired by the defendant and the matter was set for trial. At trial Mr. Venditti was able to show that even though his client did swerve his vehicle while on the highway and was speeding, that this alone was not enough to find the defendant guilty of DUI. Furthermore, Mr. Venditti was able to successfully argue that even though the open container smelled of alcohol, this was not enough to find his client guilty of having an open container of alcohol. The result was a finding of NOT GUILTY for the DUI and open container of alcohol!
