People v. M. W. (April 2019) Petition to Rescind Statutory Summary Suspension due to DUI
The defendant was charged with a DUI and as a result his license was suspended for a year. After hiring Mr. Venditti the necessary paperwork is filed to try to reinstate the driving privileges of the defendant. At the hearing Mr. Venditti argues that although the paperwork warning that the defendant’s license would be suspended if he refused to provide a breath or blood sample was signed by the defendant, the fact that it was signed is not good enough. Furthermore, Mr. Venditti also argued that the fact that the defendant was present to testify and the officer wasn’t led to a credibility issue for the state and the officer’s reports. The Judge agreed and the defendant’s license and driving privileges are reinstated!
